01Acceptance of Terms
Welcome to 9amm (9amm.online). These Terms form a legally binding agreement between you and the 9amm platform ("the Platform", "we"), governing your access to and use of the website, all studios, AI tools, subscriptions, credit systems, client portals, and any related service. By creating an account or using any part of the Platform you confirm that you have read, understood, and agreed to be bound by these Terms in full. If you do not agree to any part, you must stop using the Platform immediately.
02About the Platform
9amm is a digital platform providing AI-powered creative tools that help users create, organize, and manage digital content, prompts, designs, images, videos, projects, and visual assets, alongside client-management and sharing tools.
03Eligibility
You must be at least 18 years old, or hold explicit legal permission from a parent or guardian. You must provide accurate information when creating an account and keep your credentials confidential. You alone are legally responsible for all activity under your account, whether or not you were aware of it, where it results from your failure to protect your credentials.
04Accounts
You agree not to share your account with unauthorized persons, sell or transfer it, use misleading information, attempt to access another user's account, or bypass Platform limits and security systems. We may suspend or terminate any account that violates these Terms without prior notice and without any obligation to compensate.
05Subscriptions and Payments
Some features require a paid subscription. Pricing, features, limits, and billing cycles are shown before purchase. Payments may be processed by third-party payment providers; by subscribing you authorize the provider to charge your selected payment method per the chosen plan. You are responsible for the accuracy of your payment details and for any third-party fees or taxes.
06Credits
Platform credits are a digital usage unit — not currency and not stored value: they have no monetary value outside the Platform, are non-transferable and non-sellable, and may be subject to expiry or periodic reset per your package. Credits consumed by an actual generation are non-refundable. If a generation fails for a technical reason on our side, the deducted credits are automatically returned per the Platform's mechanism — this is the sole remedy for any failed generation.
07Renewals and Cancellations
Subscriptions may renew automatically unless cancelled before the renewal date. You can cancel via account settings, payment provider tools, or support. Cancellation stops future renewals only and creates no right to refunds of prior payments.
08Refund Policy
Refund requests are handled per our published Refund Policy and, where applicable, the payment provider's policies. Consumed digital services — AI usage, generated content, spent credits, and elapsed subscription access — are non-refundable once used, except where required by law.
09Acceptable Use
You agree not to use the Platform to create, upload, generate, publish, or promote content that is illegal, fraudulent, harmful, abusive, defamatory, infringing, impersonating others without permission, deceptive or spam, related to hacking or malware, or in violation of applicable laws, payment provider requirements, or AI model provider policies. We may remove violating content and immediately suspend the associated account.
10Your Content and Your Responsibility
You retain ownership of content you upload. By uploading, you grant us a limited license to host, store, process, and display it only as needed to provide and improve the service. You represent and warrant that you hold all rights, licenses, and permissions for anything you upload — expressly including the consent of any person appearing in photos or footage you upload or generate from. Any third-party claim arising from content you uploaded or generated is your sole responsibility.
11Client Portals and Sharing
The Platform provides share links and client portals that let you present your work to parties you choose. You are solely responsible for what you share through these links, for managing and revoking access to them, and for your obligations toward your clients. The Platform is a technical display medium only and is not a party to any agreement between you and your clients.
12AI-Generated Content Disclaimer
The Platform relies on AI systems to generate text, images, videos, audio, and prompts. Outputs may be inaccurate, incomplete, similar to existing content, unsuitable, or legally sensitive. You are responsible for reviewing and verifying any output before public or commercial use. We do not guarantee that generated content is unique, error-free, legally cleared, fit for a particular purpose, or registrable as a trademark or copyright in any jurisdiction.
13Platform Intellectual Property
The Platform, its brand, interface, software, features, design system, logos, and workflows are owned by the Platform or its licensors. No part may be copied, resold, reverse engineered, cloned, or exploited without prior written permission.
14Service Availability and Changes
We aim for a stable service but do not guarantee the Platform will always be available, uninterrupted, or error-free. We may modify, limit, replace, or permanently discontinue any feature at any time without notice and without any obligation to compensate. AI features depend on external providers and may be affected by their outages, model changes, limits, or policies.
15"As Is" Service
The Platform and all its services are provided "as is" and "as available", without warranties of any kind, express or implied, including — without limitation — fitness for a particular purpose, non-infringement, accuracy, or continuity.
16Limitation and Cap of Liability
To the maximum extent permitted by law, the Platform is not liable for loss of profits, loss of data, business interruption, reputational damage, content misuse, AI output errors, third-party service or payment provider failures, or any indirect, consequential, or incidental damages. In all cases, the Platform's total aggregate liability to you for all claims combined shall not exceed the total amounts you actually paid to the Platform during the three months preceding the claim. Your use of the Platform is at your own risk.
17Indemnification
You agree to indemnify, defend, and hold harmless the Platform and those who operate and work on it from any claim, action, loss, or cost (including reasonable attorney fees) arising from: content you uploaded, generated, or shared; your breach of these Terms; your violation of any third party's rights; or your use of the Platform in violation of law.
18Force Majeure
The Platform bears no liability for delay or failure caused by events beyond its reasonable control, including natural disasters, network outages, cyberattacks, external provider decisions, and governmental actions.
19No Professional Advice
Content generated or provided through the Platform is for creative and productivity purposes only and does not constitute legal, financial, medical, engineering, or any professional advice.
20Termination
We may suspend or terminate your account upon breach of these Terms, payment failure, misuse, legal or security risk, or where required by law or the payment provider. Upon termination your license to use the Platform ends immediately, and clauses that by nature should survive (intellectual property, limitation of liability, indemnification, governing law) remain in effect.
21Governing Law and Jurisdiction
These Terms are governed by and construed under the laws of the Kingdom of Bahrain, and the courts of the Kingdom of Bahrain have exclusive jurisdiction over any dispute arising from or relating to them, without prejudice to any mandatory statutory rights in your country of residence.
22Severability and Entire Agreement
If any clause of these Terms is held invalid or unenforceable, the remaining clauses remain in full force. These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and the Platform and supersede any prior understandings.
23Updates to These Terms
We may update these Terms from time to time; the Last-updated date changes accordingly, and we may ask you to re-accept the new version inside the Platform. Continued use after an update means you accept the updated Terms.
